Chile Adventure Guides (operated by GuideMe SpA) serves as a digital marketplace facilitating connections between Users seeking adventure tourism services and independent Guides. We are committed to the protection of your privacy and personal data.

This Privacy Policy describes how we collect, use, share, and protect your personal information in accordance with current Chilean legislation, specifically Law No. 19,628 and Law No. 21,719. By accessing and using our Platform, you explicitly consent to the collection and processing of your data as outlined herein. This policy forms an integral part of our General Terms and Conditions.

2. INFORMATION WE COLLECT

We collect information that you provide directly to us, as well as data generated through your interaction with the Platform:

  • 2.1 Registration Data: Full name, email address, password, and identification data. By creating an account, you warrant that this information is true, complete, and updated.

  • 2.2 Booking and Payment Data: Details of the services reserved, user preferences, and payment information processed through our integrated gateways (Transbank, PayPal, etc.).

  • 2.3 User-Generated Content: Photos, videos, reviews, and texts uploaded by you regarding your experiences.

  • 2.4 Communication Logs: Records of interactions between you and the Company, or between you and the Guides, conducted through our internal channels.

  • 2.5 Automated Data: Technical information including IP addresses, device types, browser metadata, and usage patterns collected via cookies and similar tracking technologies.

3. PURPOSE OF DATA PROCESSING

Your information is processed for the following strictly defined purposes:

  • 3.1 Service Provision: To facilitate the search, selection, reservation, and secure payment of adventure services.

  • 3.2 Operational Improvement: To analyze Platform performance, troubleshoot technical issues, and enhance the overall user experience.

  • 3.3 Marketing and Personalization: To send newsletters, promotions, and updates, provided you have granted the corresponding authorization.

  • 3.4 Security and Legal Compliance: To detect and prevent fraud, verify the identity of users/guides, and comply with judicial orders or statutory requirements.

4. SHARING AND DISCLOSURE OF INFORMATION

We do not sell your personal data. Your information is shared only when necessary for the execution of the contracted service:

  • 4.1 With Guides: Upon confirmation of a booking, your contact details and specific requirements are shared with the Guide to coordinate service delivery.

  • 4.2 With Financial Service Providers: Transactional data is shared with payment gateways to process payments securely.

  • 4.3 Legal Requirements: We may disclose data if required by competent Chilean authorities, court orders, or to protect the safety and rights of the Platform and its community.

5. USER RIGHTS (ARCO RIGHTS)

In accordance with Chilean law, you possess the following rights regarding your personal data:

  • Access: The right to know what data we hold about you.

  • Rectification: The right to update or correct inaccurate information.

  • Cancellation (Erasure): The right to request the deletion of your data when it is no longer necessary for the purposes collected.

6. IMAGE RIGHTS AND USER CONTENT

In alignment with Clause 8 of our Terms and Conditions, by uploading visual content (photos/videos):

  • You grant Chile Adventure Guides a worldwide, royalty-free, and transferable license to use this content for promotional purposes.

  • You confirm you have the necessary authorizations from any third parties appearing in said content.

  • You release Chile Adventure Guides and the Guide from any liability regarding third-party image right claims.

7. LIMITATION OF LIABILITY

As established in our Terms and Conditions, Chile Adventure Guides acts solely as an intermediary (Marketplace). We are not responsible for the data processing practices of independent Guides once direct communication is established outside the Platform, nor for the quality or execution of the physical services provided by them.

8. DATA SECURITY

We implement technical and organizational measures to protect your data against unauthorized access, loss, or alteration. However, since no electronic transmission is 100% secure, the User is responsible for maintaining the confidentiality of their account password.

9. MODIFICATIONS

We reserve the right to update this Privacy Policy to reflect changes in our practices or legal requirements. Modifications take effect immediately upon posting. We encourage users to review this page periodically.
